Product Safety and Regulatory Compliance
Vista Outdoor operates in a highly-regulated environment in the U.S. and international markets. U.S. federal, state, and local governmental entities, and foreign governments regulate many aspects of our business through product safety standards, laws and regulations, including the California’s Safe Water and Toxic Enforcement Act, Europe’s Registration, Evaluation, Authorization and Restriction of Chemicals (REACH), Europe’s Restriction of Hazardous Substances Directive (RoHS), the US Toxics in Packaging Clearinghouse (TPCH) and others.
While employees at each of Vista Outdoor’s individual brands work to ensure compliance with the product safety laws and regulations that apply to their products, Vista Outdoor also has a team of dedicated professionals within the corporate Compliance Department who oversee all aspects of product safety and compliance across the enterprise. Vista’s Product Safety and Compliance personnel have broad and diverse academic and experience credentials, and are often sought out by regulators, law enforcement, other industry participants and internal stakeholders to serve as expert consultants and witnesses. This organizational structure, together with robust internal policies and procedures, help ensure that Vista Outdoor meets its continuing obligations to regulators and consumers throughout the product life cycle.
Risk-based pre-production product safety reviews are performed for all new product lines prior to their release to the market. These reviews are designed to identify and address risks arising from product designs, manufacture and warnings. For example, in our bicycle helmet category, before any helmet is released to the market, our engineers, designers and product safety engineers plan testing both at internal and external independent laboratories. Once a bicycle helmet is placed into production, batch testing and inspections are performed to assure product safety and compliance during production.
A dedicated team of product Regulatory Compliance Engineers review products in development for compliance with global regulatory standards covering numerous areas, including chemistry, electronics, labeling, advertising claims, testing, and environmental regulations. These engineers represent their brands as members of the Vista Outdoor Compliance Council as stated in the Product Compliance Council Charter. These engineers represent their brands as members of the Vista Outdoor Compliance Council. Various proprietary tools are used to help ensure all regulations are considered for the market where our products will be sold. The Vista Outdoor Compliance Council also monitors new regulations in development in various countries and states to assure continued product compliance even as new regulations are developed. Vista Outdoor Regulatory Compliance engineers participate in the development of new standards being developed by ASTM International and the American National Standards Institute (ANSI) as contributors and, in some cases, as Sub-Committee Chairpersons.
Vista Outdoor also actively monitors and solicits information on the use and performance of its products in the field in an ongoing effort to ensure the safety and compliance of its products. The Company’s Escalation Policy requires all employees to escalate any safety incidents in the field, which are documented and investigated. Corrective or remedial actions are considered and taken whenever necessary and appropriate, including post-sale warnings, product recalls, manufacturing modifications, design changes and warning enhancements.
When a safety incident is reported internally, reporting obligations to regulatory agencies are considered following a thorough risk assessment of the information received. For its consumer products, Vista Outdoor welcomes and encourages partnership with and oversight from product safety regulators such as the US Consumer Product Safety Commission (CPSC) and Health Canada. We take a very conservative approach toward reporting in many cases and, even when the cause of an incident is in doubt, often share information in the spirit of transparency and cooperation.
